Until 2007, power over deposits lay with the landlord, now it lies with the
tenant.
The issue of the return of the deposit at the end of the tenancy is one of the major sources of conflict between landlord and tenant. In April 2007 the government introduced Tenancy Deposit Protection and Tenancy Deposit Schemes. Because of this legislation, when it comes to returning the tenant’s deposit, without a properly completed Property Inventory and Schedule of Condition, landlords will find it extremely difficult to justify any deductions they may want to make. The tenant is considered innocent until proven guilty.
The Dispute Service was handling around 6,000 disputes between landlord and tenant in 2007/08. Latest figures show that this has increased to a staggering 12,000 disputes within the last year - and many of those cases show landlords losing due to lack of satisfactory paperwork. (for example, in a smaller ‘mydeposit’ study 91% of findings were in favour of the tenant, landlords losing an average of £733.00 each time)
